Same codebase ... see the wiki.bitcoin.it wiki for that malleability ... not so interesting in general .. mtgox's software fucked up .. not bitcoin

Upon further reading this is what seems to be the case. A flaw, but considered a "minor" flaw. Who knows though...
Looks like Decentralized Exchanges are going to be mighty sexy though when people start realizing en-masse that most of this mess was Mt Gox..

It could effect BitShares PTS, but not BitShares X as I use an entirely different code base that doesn't have this particular issue.
